Monterey Select Board
Minutes of the meeting of 6/28/10
Meeting Opened at: 4:00pm
Select Board Members Present: Jonathan Sylbert, Chairperson (arrived at 5:30 after a site visit at the Monterey School), Wayne Burkhart, and Scott Jenssen
Also in attendance for parts of the meeting: Sue Protheroe for the Monterey News, Maynard Forbes, Director of Operations, Michael Storch, Scott Rote of Wheeler and Taylor, Josh Allentuck (Parks Chairperson), Steven Pullen (Accountant) and Raymond Tryon (Fire Chief)
The board met with Police Chief, Gareth Backhaus to review the following items:
1. Assisted with a medical call on Main Rd.
2. Loose cows on Blue Hill Rd.
3. Assisted the Fire Department with an alarm on Beartown Mtn Rd.
4. Responded to 2 well being checks; one on Main Rd and one on Pixley Rd.
5. B&E reported on Beartown Mtn Rd; nothing was reported taken.
6. Suspicious activity reported on Mew Marlboro Rd; it turned out to be a Mass Environmental employee doing work.
7. Suspicious activity reported on Lake Garfield; it turned out to be the Fire Department performing practice with their airboat.
8. Suspicious activity reported on Blue Hill Rd; this is a recurring complaint and nothing is found when police arrive.
9. Responded to Gould Farm to assist with a situation.
10. There is an abandoned house on Sylvan Rd that has a family of raccoons living in it. The Police Chief wanted to know if it could be considered an attractive nuisance. Chief Backhaus will follow up with other town departments.
11. Abandoned 911 call.
The board met with Inter-Departmental Secretary, Melissa Noe to review the following items:
1. Weekly report was reviewed.
Miscellaneous Select Board Items Reviewed:
1. At 4pm there was a bid opening for truck equipment for a Ford F550. Only one bid was received from Howard P. Fairfield Municipal Specialists with several options available. M. Forbes recommended accepting the bid. A motion was made to accept the bid with options 1 & 2, which was seconded and unanimously approved.
2. The minutes from 6.21.10 were approved as written.
3. Three sets of warrants were signed due to the end of the FY10, beginning of FY11 and the treasurer going on vacation.
4. The Board reviewed the bid protest documents received from Gary O’Brien’s attorney. Josh Allentuck, Chair of the Parks Commission asked the Board for direction on the matter and who should be mowing as of July, the Select Board has forwarded the documentation to Town Counsel to review and advise.
5. Scott Rote came in with a proposal for the Town’s property, casualty, workman’s comp and liability insurance through Wheeler & Taylor. The volunteer fire services insurance was not included in the quote, nor was health insurance. The Board agreed that it was too late in the process now to switch companies but would be agreeable to receiving bids from them for next year.
6. Jon reported to the Board what occurred at the Monterey School Committee meeting to review the immediate repairs needed to keep the Monterey School open. Present were Andy Fetterhoff, Steve Willig, Vito Valentini, Charles Flynn, Jonathan Sylbert and Maynard Forbes. The Building was not unlocked so everyone was unable to get in the building to view the issues at hand but did agree on the minor repairs being fixed so that the program may continue in that building for the 2010-11 school year while other options are reviewed for the following school years.
7. Raymond Tryon, Fire Chief came in at the Board’s request. The Select Board has been informed that town employees are not insured under the town’s liability and injury on the job coverages once you are over the age of 70. Ray stated he would sign a waiver but in Hancock the Select Board was informed a waiver would not protect the town. Ray also informed the Board that the Town of Monterey never voted the MGL chapter that allows the town to have a fire department legally. Ray also noted that the Fire Inspector is appointed by the Fire Chief not the Select Board under MGL. The Board understood and has always made the appointment for the Fire Inspector based on the Fire Chief’s recommendation. The Board has asked M. Noe to research the insurance issue with MIIA as well the
town not having a legal Fire Department with Town Counsel.

9. It has been confirmed that the Dog Officer position falls under the purview of the Select Board and not the Board of Health. This appointment will be made on 7/12/10 after speaking with the Police Department and Town Counsel.
10. The Board agreed to eliminate the Town Report Committee and that Melissa Noe will continue to handle this responsibility.
11. Due to a lack of activity over the last 5 years, the Board also agreed to eliminate the Solid Waste Committee.
12. Scott has spoken with a ZBA member about the proposed Wilson McLaughlin House driveway and this person feels that placement of the driveway on RT 23 would be extremely dangerous. The Board did not feel that the driveway fell under the ZBA’s authority; it would fall under the Director of Operation’s jurisdiction.
A motion was made and unanimously approved to adjourn the meeting at: 6:20pm
